緬甸：停止政變！讓選舉法庭做他們該做的事！

Myanmar: Stop the coup, let election tribunals do their job

台灣時間2月1日，緬甸國防軍─塔瑪都（Tatmadaw）表面上是回應選民對2020年11月8日大選舞弊事件的指控，拘留了許多政府官員，包括國務委員翁山蘇姬（Daw Aung San Suu Kyi），總統溫雲（U Win Myint）和聯邦選舉委員會（UEC）主席U Hla Thein，以及來自世界各地的民主運動人士和政治家執政的全國民主聯盟（NLD）和其他政黨。

國防軍隨後宣布奪權，緬甸進入為期一年的緊急情況（state of emergency），並任命副總統兼前將軍U Myint Swe為代理主席，同時由新的選舉委員會重新舉行一場選舉。

人權團體紛紛譴責緬甸軍方的政變，呼籲立即釋放所有被拘留的政治人物、政府官員和維權人士，並恢復民主政府的權力。若軍方想要尋求選舉的真相，應透過2008年《憲法》建立的正當法律程序進行偵查，而非流於武力政變。

緬甸本來就有選舉法庭的機制，可依法解決選舉相關爭議。軍方支持的聯盟團結與發展黨（USDP），屢次宣稱此次大選受到操縱和出現不法行為，就如同其他利害相關者一樣，軍方也擁有質疑選舉結果的合法權利。對於選舉結果不服的287項指控中，聯邦選舉委員會（UEC）也確實接受了其中的174項指控。

緬甸的觀選團體希望能透過找尋證據，依法解決選舉爭議。根據ANFREL的資料，聯邦選舉委員會其實在軍事政變前就已經任命選舉法庭。解決選舉爭議是任何選舉程序不可或缺的一部分，但運作的前提是，各方都能真誠以待。

鑒於此，我們要呼籲，緬甸國防軍（Tatmadaw）應放棄其政變企圖，改以和平、透明的方式解決選舉爭議。

全面民主化本就是一條漫長而艱鉅的道路，各方利益相關者都應致力於保障民主，這是非常重要的。1990年大選後的殷鑑不遠，威權、非民主的作法是不被緬甸人民與國際社會所接受的！
